Terms and Conditions

Our Website is owned and operated by Perfectly Portugal Limited, a company registered in England and Wales under number 6316954 registered office 1 Saville Chambers, North Street, Newcastle upon Tyne NE1 8DF, United Kingdom email ola@perfectlyportugal.eu; tel 01914066257. These are the terms which govern Your use of Our Website and the accessing and use of the services described on it. Also set out below is our privacy policy.

In the terms which follow, we use the following terms:

accommodation”  -  means accommodation advertised on Our Website by an Owner;

Our Website”  -  means the pages visible from time to time at www.perfectlyportugal.eu;

Owner”  -  means a person whose accommodation is advertised on Our Website;

Us”, “We”, “Our”  -  means Perfectly Portugal Limited, as described above;

You”, “Your”  -  means you, a visitor to Our Website.

Our Website is targeted at residents of the European Union, United States of America, Canada, Australia or New Zealand only. If you are not resident in the European Union, United States of America, Canada, Australia or New Zealand DO NOT USE OUR WEBSITE. In listing your place of residence and delivery address in Our booking form, You are representing to us that you are resident in the European Union, United States of America, Canada, Australia or New Zealand. This is a representation on which we, and Owners, rely. Using Our Website indicates your acceptance of these terms and of Our privacy policy: if you do not accept them, please do not continue to use Our Website. No booking of accommodation will be accepted on Our Website from any person under the age of 18 years, or the age of majority in the country in which they are domiciled and You represent to Us that your age is such that we are willing to accept a booking from You, as indicated above.

The clauses numbered 1-3 below relate only to the booking of accommodation; clause 4 deals with use by You of Our Website generally and includes exclusions of Our liability to You, and that is followed by our Privacy Policy. If you have any queries about any of Our terms, or if anything is not clear to You, please contact Us.

ACCOMODATION

1. We act as Agent for Owners

1.1  -  When We arrange for accommodation to be reserved on Your behalf, We act as agent for an Owner, which means that the contract for Your stay at accommodation which you choose will be between You and the Owner, rather than between You and Us. As We act as agent for the Owner, We have no contractual liability to You in respect of the letting of any accommodation. The assessment and selection of accommodation is Your responsibility.


1.2  -  Each Owner has their own terms and conditions of letting, which will apply in respect of the contract between you and the Owner for the letting of the accommodation. All relevant terms and conditions will be available to you on Our Website before you complete your transaction. You should ensure (and You will be asked to confirm You have done so by checking a box on the booking form) that You have read and understood those terms and conditions (and these terms relating to Our Website) before entering into an agreement with an Owner.

1.3  -  If You request and We (or the Owner of accommodation) agree and are able to arrange the provision of services related to accommodation (such as the availability of a cook), then all contractual and other arrangements (including as to payment between You and the provider of any such services are made between You and the provider, and (as set out in clause 4 below) We shall not be liable in respect of any such arrangement unless we otherwise agree in writing, We do not act as agent for any such provider and do not make any recommendation of that provider.

2. Booking

2.1  -  You may make a binding or provisional booking in respect of accommodation You wish to occupy. If the Owner has a Paypal account, you may make a binding booking by paying the deposit for your booking when you make the booking: all other bookings are provisional until payment is made by bank transfer (and will be cancelled if payment of the deposit is not made as required). If You make a provisional booking , it will be held for seven days and will be confirmed if You pay the deposit payable within that period by bank transfer (Clause 3 below gives details of payment methods).


2.2  -  If the dates You wish to book are shown in green on the calendar on the page on Our Website relating to the accommodation You wish to book, You may proceed to make a binding booking (if the Owner has a Paypal account) or a provisional booking to let the accommodation by following the instructions on reservation and payment which will be displayed to You.


2.3  -  If the dates which you wish to book are shown in yellow on the calendar on the page on Our Website relating to the accommodation You wish to book, We will pass Your requirements to the Owner of the accommodation in question: We will then email You within 72 hours to either confirm its availability or to let You know that it is not available. If it is available You will then be able to make a binding booking (if the Owner has a Paypal account) or a provisional booking (which will be held for seven days) of the accommodation, through Our Website.


2.4  -  Where dates are shown in red, the accommodation is not available on those dates.

3. Payment of Deposit and Handling Fee

3.1  -  To secure a booking of accommodation You will have to pay a deposit of 25% of the total cost of the accommodation You wish to book. You may pay either by PayPal (if the Owner has a Paypal account and if You make a binding booking by paying the deposit when You make the booking) or (in all other cases) by bank transfer to the Owner of the accommodation You wish to book. A booking made by bank transfer will be provisional only until payment is received by the Owner, at which time We will confirm receipt to You by email (and any provisional booking You make will be cancelled if You do not make payment as required).


(i)  -  If You choose to pay by PayPal, You will pay a handling fee of 10 Euros. Subject to these terms, a binding booking will be made when You make the required payment by PayPal;


(ii)  -  If You choose to pay by bank transfer, We will send You by email the bank account number (IBAN) and bank code (BIC) of the Owner of the accommodation which You wish to book and You must then make payment of the deposit to that bank account within seven days of the date on which You make your reservation (If payment is not received within that period, your reservation will be cancelled). The bank and any other charges relating to the bank transfer will be payable by You.


3.2  -  A booking may be cancelled if any payment which is due is not made, or You have given Us incorrect information. Following completion of a booking (or making provisional booking) You will be sent confirmation by e-mail. You should check that the booking details are correct, and advise Us by e-mail if they are not.


3.3  -  Each Owner’s own terms and conditions will apply in respect of how the balance of the rental for the accommodation you have booked is to be paid, and in respect of cancellation. We will send You an email (after You have paid Your deposit) confirming when the balance is payable, and how You should pay it.


3.4  -  The Owner may make additional charges in the event that You wish to amend Your booking (these charges will be provided for in the contract between You and the Owner).


3.5  -  It is important that all information which You give us is correct. This includes ensuring that We have Your correct contact details at all times. It is your responsibility to inform Us of any changes by e-mail as soon as possible, as mentioned at paragraph (h) of our privacy policy. We will not be liable if You do not receive any relevant information because You have given us incorrect details, or they have become out-dated.


OTHER TERMS

4 General Terms of Use of Our Website

4.1 EXCLUSION AND LIMITATION OF OUR LIABILITY:

(i) Accommodation

All the information concerning accommodation visible on Our Website, including descriptions and details of prices and availability, has been provided to Us by Owners. Descriptions are not intended to amount to, and are not, advice on which reliance may be placed. We therefore disclaim all liability which may arise from any reliance which may in fact be placed on such materials by any visitor to our Website. Although We ask Owners to keep information concerning their Properties up-to-date, any of the material on Our Website may be out of date at any given time, and We ourselves are not in a position to, and under no obligation to You to, update such material.

(ii) Other information

Other material posted on our website and which We may send to You at any time (including, but without limitation, travel information and information concerning the area within Portugal within which You have booked accommodation through our website) is provided as general information and does not constitute specific advice on which reliance may be placed. The information contained in all such material is believed by Us to be up to date when it is posted on Our Website or otherwise issued by Us but we disclaim all liability which may arise from any reliance which may in fact be placed on such materials by You or by any visitor to Our Website.

(iii) General

All information available on Our Website from time to time and/or provided to You by Us in any other way is provided by Us using reasonable care and skill, but otherwise without any guarantee, condition or warranty as to its accuracy, and to the extent permitted by law, We expressly exclude all other conditions, warranties and other terms which might otherwise be implied by statute, regulation or common law. We also exclude liability for any loss or damage (including, but not limited to, any liability for loss of expectation, loss of anticipated savings, loss of data, wasted time, loss of goodwill, profits or contracts, and/or for any other loss or damage of any kind, however arising and whether caused by our negligence, breach of contract by Us, or otherwise) which is incurred in connection with Our Website and/or in connection with the use, inability to use, or results of the use of (including, without limitation, the booking of any accommodation and the provision of any services), Our Website, any websites linked to it and any materials visible or otherwise available on it, and/or with information otherwise made available by Us. However, We do not by any of these terms exclude or limit liability for death or personal injury caused by Our negligence or the negligence of Our employees or agents, or for fraud or fraudulent misrepresentation, or for any other liability to You which may not lawfully be excluded or limited, nor do any of these terms limit any of Your rights as a consumer of which You otherwise have the benefit in the country in which you are domiciled (and which may not lawfully be excluded or limited).

4.2  -  We are the owner or the licensee of, or otherwise have the right to use, all intellectual property rights in Our Website and in the material visible or otherwise available on it. You may print off a copy, and may download extracts, of any page(s) from Our Website for your personal (non-commercial) use, but You may not otherwise copy or use any of that material.

4.3  -  You must not introduce to Our Website any software, or any material which is malicious or harmful. You must not attempt to gain unauthorised access to Our Website, the server on which Our Website is stored, or to any server, computer or database connected to Our Website. We reserve the right to bar Users from Our Website on a temporary or permanent basis, at Our discretion.

4.4  -  We carry out regular anti-virus checks, but will not be liable for any loss or damage caused by viruses or other harmful material that may affect Your computer equipment, computer programs, data or other proprietary material due to your use of Our Website, or to your downloading of any material posted on it, or on any website linked to it.

4.10  -  These terms are governed solely by English law, and (subject to any rights you may have to bring proceedings in the country in which You are domiciled) the English courts will have exclusive jurisdiction over any claim arising from, or related to, these terms and/or to our Website (although We reserve the right to bring proceedings against You in any other jurisdiction for breach of these terms).

PRIVACY POLICY

This Privacy Policy sets out Our policy with regard to personal information. If You have any requests concerning Your personal information, please contact Us at 1 Saville Chambers, North Street, Newcastle upon Tyne NE1 8DF, United Kingdom.

(a)    We collect personal information from visitors to Our Website through the use of online forms, and when You email us: this information is your name, address, email address, telephone number and any other information which You submit toUs. We also collect additional information automatically about Your visits to Our Website.

(b)    We use and process personal information collected through Our Website for the purposes of providing Our Website, dealing with your enquiries and requests, providing You with information about accommodation offered by Owners, facilitating contracts between You Owners, and communicating with You generally.

(c)    We use 'cookies' (a ‘cookie’ is a small piece of information sent by a web server to a web browser, which enables the server to collect information from the browser) to identify You when You visit Our Website and to keep track of your browsing patterns. You may prevent the use of cookies by reconfiguring Your web browser, but please note that this may hinder some of Our Website’s functionality.

(d)    We may disclose your personal information to our advisers, successors and to potential successors to Our business (and to their advisers) and to suppliers We engage to process data on our behalf, and otherwise as required by law.

(e)    Our Website may contain links to other websites which are outside Our control, and are not covered by this Privacy Policy. If You access other websites using the links provided, the operators of these sites may collect information from You which may be used by them: they may not have a privacy policy, or may have a privacy policy the terms of which are different from Ours.

(f)    We may also wish to provide You with information about special features of Our Website we think may be of interest to you. If You would rather not receive this information, please send an e-mail to ola@perfectlyportugal.eu.

(g)    The internet is not a secure medium. However, We have put in place various security procedures, as set out in this policy to endeavour to keep your information confidential.

Our internal procedures cover the storage, access and disclosure of Your information.

(h)    If any of the information that You have provided to Us changes, for example if You change Your e-mail address, please let Us know the new details by sending an e-mail to ola@perfectlyportugal.eu.

(i)    By submitting information about You to Us, and by using Our Website, You consent to the use of that information as set out in this policy. If We change Our privacy policy We will post the changes on this page, and may place notices on other pages of the website, so that You may be aware of the information we collect and how we use it. We will also e-mail You should we make any changes so that You may consent to Our use of your information in that way. Continued use of the service will signify that You agree to any such changes.

(j)    Owing to the global nature of the Internet infrastructure, the information you provide may be transferred in transit to countries outside the European Economic Area that do not have similar protections in place regarding Your data and its use as set out in this policy. However, We have taken the steps outlined above to try to improve the security of Your information. By submitting your information You consent to such transfers.
